If it's still under warranty, your best bet would be to speak with Nintendo directly. They would be able to facilitate its repair the fastest.

If you're out of warranty and did not opt for a Product Replacement Plan, or if your PRP has expired, Nintendo should still be able to repair or replace the unit for you, but it won't be for free. I'm not certain of exactly how much they charge from first-hand experience, but customers I've spoken to who have gone this route report a cost of roughly half the purchase price of a new unit (not including shipping). This may vary depending on the work that needs to be done, so I would suggest calling first to confirm.

If you decide to simply purchase a new unit, I would strongly recommend adding a PRP contract onto the new system. It only costs about thirty bucks and covers you against virtually anything that could go wrong, from normal wear and tear, to performance problems, to stuck buttons, etc - with the exception of physical damage resulting from abuse - for two full years. If you tend to have a lot of problems with game systems, you might find it's a nice route to go.

Nintendo has a very good customers service, even when you're not in your product warranty period anymore. One of my cousin had his DS touchscreen stop working after the warranty was over and Nintendo exchanged his out of warranty DS for a brand new one(easy to tell, he sent a white one and received the crimson red one...) and all of this only cost him $55. Not to forget that the process took only 2 weeks from the moment he sent his one to the moment he received the new one.
