Used game with fake slip cover legal?

I just purchased a used game from their online website. When I opened the game I realized that the cover slip was a photocopied/printed version. I contacted customer service and was told that they copied it for advertising purposes and I cannot exchange the item.

 

Is it legal for a retailer to sell an item with a photocopied/printed slip cover? Isn't this copyright infrigement? 

The other place that sells used games never photcopies games, but sells it in blank cases.
