when i buy a game and the sticker is still on the side of the case does it consider new?

If it is still sealed in the plastic wrap that it was sold in, then yes, it is considered new.

If the sticker is on the side, it's no longer considered new. If the plastic wrap the game comes in is still on there, then it's considered new.
