The information you provided is kind of vague but I can work around it.
If you mean the 3rd generation iPod Touch (the one before camera was featured on)
You must have the feature " Shake to shuffle" on.
You can disable it by going into the settings and going into the iPod tab.
If you do not have this iPod Touch and are talking about something else, i suggest going back to the store or upgrade to the new versions.
